Breach of Contract - lost profits. Major non-profit in San Diego area decided to expand their car donation program to other markets around the country. Those operations failed and the non-profit sued for breach of contract and lost profits. We showed that plaintiff's lost profits analysis was flawed and that the failures of the expansion operations were not caused by the actions of the defendant. We also discovered questionable marketing and financial data by the non-profit plaintiff that was pertinent to a counter claim.
Fraud and Embezzlement. Employee of a high profile non-profit in Sacramento, CA embezzled funds for personal use. Investigated the documents recovered during the criminal investigation and the books and records of the non-profit during the time of the crime. Found that the police investigation was not reliable and duplicative in its allegations. Report to defense counsel was accepted and praised by the court and prosecution, resulting in a conclusion to the long standing case and a favorable outcome for the defense.
