Partnership Dispute. Large San Diego mixed use housing development in dispute over the distribution of funds from the project. Highly contentious preceding that used several experts from large CPA firms. No resolution was obtained. Business partner appointed Special Master by judge to review the books and records of the various entities involved and report on specific issues the court requested. Reviewed documents, books and records, and interviewed key personnel and kept all parties informed of activities. Reported findings to the court.
Contract Dispute. Commercial real estate building was sold. Buyer sued seller for breach of contract and non-disclosure of defects. Reviewed contracts and subsequent operations, books and records to determine if plaintiff's claims withstood scrutiny. Report and testimony resulted in favorable decision for defendant client.
Contract Dispute. Developer of large apartment project sued, and was counter-sued, by general and some subcontractors. Developer sought to recover damages due to defendants' non-performance of work, work not completed on schedule, over-billing, sub-standard work, and work that had to be re-done. Evaluated progress billings to developer, compared billings to contract terms, and work actually completed. Calculated amounts developer actually owed for work that was done, and any overpayments to be returned to developer. Prepared notebooks and exhibits for arbitration.
Partnership Dispute, Damage Calculation. Representation of minority partner in real estate partnership. Reviewed records of partnership; calculated amounts due minority shareholder caused by misappropriation of partnership assets by controlling partners, including interest-free loans to related parties, below-market rent to related party and failure to advertise certain property for rent. Valued current worth of partnership and minority partner's interest. Prepared trial notebooks and trial exhibits. Trial testimony.
